Welcome to Text Moment. By downloading, installing, or using our app, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the app.

1. Acceptance of Terms

By downloading, installing, accessing, or using Text Moment ("the App"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, you should uninstall the App and discontinue its use.

2. License and App Usage

• License Grant: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes.
• Restrictions: You agree not to, and will not permit others to, modify, make derivative works of, disassemble, reverse compile, or reverse engineer the App, or attempt to do so.
• Updates: The App may automatically download and install updates from time to time. These updates are designed to improve, enhance, and further develop the App and may include bug fixes, enhanced functions, new software modules, and completely new versions.

3. Subscription Services

• Free and Paid Services: The App offers both free and paid subscription services. The free version provides limited features, while the paid subscription unlocks additional functionality.
• Billing: By subscribing to the paid version, you agree to pay all fees in accordance with the applicable payment terms presented to you at the time of purchase.
• Auto-Renewal: Subscriptions will automatically renew for the same subscription period unless canceled at least 24 hours before the end of the current period.
• Cancellation: You can manage and cancel your subscription through your app store account settings.
• Refunds: Refund requests are handled by the respective app stores (Apple App Store or Google Play Store) according to their policies.

4. User Content and Data

• Ownership: You retain all rights to any documents, images, or other content you scan, process, or create using the App.
• No Storage: We do not store your scanned documents on our servers. All document content is stored locally on your device.
• Temporary Processing: When using AI features, document content is temporarily transmitted to secure API providers for processing and is not retained after processing is complete.
• Responsibility: You are solely responsible for all content you scan, process, or create using the App, and for ensuring you have the right to scan and process such content.

5. Prohibited Uses

You agree not to use the App:

• For any illegal purpose or to violate any laws or regulations
• To infringe upon or violate the intellectual property rights or other rights of others
• To transmit any viruses, malware, or other harmful code
• To interfere with or disrupt the App or servers or networks connected to the App
• To attempt to gain unauthorized access to any portion of the App or any other systems or networks

6. Intellectual Property

The App, including its design, structure, organization, source code, and all content (excluding User Content), is owned or licensed by us and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any content from the App without our express written permission.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, OR THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE APP.

9. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the App, violation of these Terms, or violation of any rights of any other person or entity.

10. Changes to Terms

We may modify these Terms at any time by posting the revised terms on our website or within the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Georgia, United States, without regard to its conflict of law provisions. For users outside the United States, these Terms shall not override any applicable consumer protection laws in such jurisdictions.
